1. Data collection

Plantura offers you various services that you can use in different ways. When you use these services, various data is collected from different sources. Much of the information you provide is directly to us, such as your e-mail address or postal address when you order products, or your telephone number when you call our customer support line. Plantura also receives technical data when you use our services, such as device or access data collected when you interact with our services. We also collect data through our own data analytics (e.g. for analysing and evaluating customers). In the following, we will go into detail about the different types of data.

1.1 Profile data
To register with us in the online shop, you provide personal and demographic information about yourself. This data can be, for example, your first and last name, your contact details and personal details such as your date of birth. However, you are required to provide your name, e-mail address and a password.

1.2 Contact details
As soon as you contact us, we record the data you give us for this purpose. Depending on how you contact us, we record different data. In the case of telephone calls, we record your telephone number; in the case of written communication (especially e-mails), we record your e-mail address and postal address; and when you contact us via social networks, we also record contact details.

1.3 Purchasing data
When you place an order with Plantura, we collect your purchasing information. This data may include data such as order number, information about the items purchased, use of payment method, delivery and billing address, delivery and order status, return status and other data necessary for the execution of the shipment, as well as details of service providers involved in the shipment who hand over the parcel tracking numbers.

1.4 Payment data
For your purchase we offer common payment methods, in particular purchase by credit card (e.g. Visa or Mastercard), purchase on account, immediate transfer, but also PayPal. Credit card payments are processed via our online shop provider Shopify, PayPal is processed via PayPal, and we offer purchase on account via the payment provider Klarna. You can find more information about the data with our payment service partners under the section Data transfer.

1.5 Interest data
When you interact with our content and offers, data is collected which we can use to draw conclusions about interests such as content, topics and products. For example, if you frequently read articles on certain topics, we can draw conclusions about which products might be relevant to you.

1.6 Messages and conversation content
If you contact us by post, telephone or via contact forms or social media offers, we record the content of your messages. We also use social media services such as Instagram, Facebook, YouTube or Pinterest for communication purposes. We use these offers to provide you with contact and information opportunities. However, we have no influence on the terms of use of these offers. 

1.7 Data from social media
Plantura has various social media presences such as on Instagram, Facebook, Pinterest or YouTube. In addition, functions from these providers may be integrated, such as plug-ins or messenger services. Where applicable, we may receive data from them that identifies you. This data may be, for example, your public profile information (name, profile picture), details of your device types or your profile ID. 

1.8 Information about your location
By collecting the IP address of your device, conclusions can be drawn about your location (These conclusions are used, for example, in fraud detection in our online shop. This allows us to detect potentially suspicious orders that are transmitted from different locations).

1.9 Personal content (such as photos or voice feedback)
With some of our offers (e.g. the individual lawn consultation) you can send us photos of your garden. We use these photos to provide you with personalised advice and, where appropriate, product recommendations. 

In the Plantura app, we use a function that allows you to send us voice messages. We use the content of the voice message to improve the app.

1.10 Applications
For applications to Plantura GmbH, we use external applicant management systems such as Personio and Join. Further explanations can be found under the point Data transfer.

1.11 Data from devices and accesses
When you use Plantura’s services, it is inevitable at many points that technical data will be generated and processed in order to make the services available to you. This data can arise, for example, on our websites, apps, social media presences, emails. The data can be identification data (such as session IDs, cookie IDs, unique device identification numbers, account IDs to recognise your device), general device information (e.g. language settings, system authorisations, mobile network) or access data for online access (in the context of HTTP requests as well as further information on server access and data on your device).

2. Data processing

Plantura processes your data in compliance with the Data Protection Act. The basis for the processing of this data is provided by the DSGVO (Basic Data Protection Regulation) and in particular, but not exclusively, Art. 6 “Lawfulness of processing”. The processing is primarily carried out for purchase processing and the provision of the offers as well as the personalisation and further development as well as security of our offers. In the following sections, we explain in detail which legal basis we use for the use of your data.

2.1 Purchase processing & e-learning material
Plantura processes your data in order to fulfil the contract and provide the offers you have ordered. Depending on the offer you take up with Plantura, your data will be processed differently. The main purposes of the processing are: 

  • The fulfilment of sales contracts, in particular shipping and payment processing, claims management and the processing of returns, complaints and warranty cases.
  • The provision of e-learning material 
  • The guarantee of security, operability, stability of our offers and the defence against attacks
  • The issuing, redemption and delivery of vouchers
  • The implementation of promotions and competitions

The basis for processing this data is based on Art. 6 (1) b of the DSGVO.

2.2 Personalisation
In order to provide a useful and convenient use of our offers, we may personalise the offers according to your needs. As Plantura’s offering, in particular the magazine, comprises thousands of articles, it may be necessary for us to present the content and offers in this content in a needs-based manner so that you receive the content and offers that are actually of interest to you. This approach requires a user-specific assessment of the relevance of articles and products.

In order to be able to provide you with a personalised offer, we use device and access data that we use for usage analyses. If you are logged in with your customer account or use our offers with a device known to us, we also use the profile data, interest data and purchase data to be able to offer you the personalisation. Only with this type of personalisation can we offer you the appropriate article and product suggestions. This type of personalisation is carried out by many online shops as standard and is often listed as onsite optimisation. You can of course access all Plantura offers despite the personalisation.

The basis for processing this data is based on Art. 6 (1) f of the DSGVO.

2.3 Fraud prevention
In order to protect ourselves against fraudulent orders, we use a technical and manual procedure. For this purpose, purchasing data and ordering habits are automatically analysed for each order and compared with previous usage and ordering habits. In addition, a comparison is also made with general data records of orders placed with Plantura, which offer conclusions about fraudulent behaviour. In some cases, the potential risk of fraud is classified as very high, which leads to a deactivation of the customer’s account and a cancellation of the order. This process is then carried out by manual processing.

The basis for the processing of this data is based on Art. 6 (1) b of the DSGVO.

2.4 Collection service provider
If you fail to pay your outstanding invoice after several reminders, we may pass on your details to a debt collection service provider to recover the outstanding debt. Alternatively, we may sell the debt to a debt collection service provider, who will then enforce it in their own name.

In the case of a trustee collection procedure, the basis of the processing of your data is based on Art. 6 (1) b of the GDPR, and in the case of the transfer of your data and the sale of the debt, the basis of the processing is based on Art. 6 (1) f of the GDPR.

2.5 Data analyses
We use your data in the context of data analyses. We can use the data to create a user segmentation and derive insights into usage habits and buying and reading interests, how our offers are used.

The basis for the processing of this data is based on Art. 6 (1) a of the GDPR if you have given your consent. Furthermore, the basis for the processing of your data is based on Art. 6 (1) F of the DSGVO. We use the following technical service providers for the data analyses:

Google Tag Manager: a tag management system offered by Google by means of which JavaScript and HTML code snippets can be implemented to enable analysis, tracking and personalisation offers.

Offered by: Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland.

Google Analytics:
Insofar as you have given your consent to this in accordance with Art. 6 (1) p. 1 lit. a DSGVO, this website uses Google (Universal) Analytics for the purpose of website analysis. The web analytics service is provided by Google Ireland Limited, a company incorporated and operated under the laws of Ireland, with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland. (www.google.de). Google (Universal) Analytics uses methods that enable an analysis of your use of the website, such as cookies. The information automatically collected about your use of this website is usually transferred to a Google server in the USA and stored there. By activating IP anonymisation on this website, the IP address is shortened before transmission within the Member States of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The anonymised IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. After the end of the purpose and the end of the use of Google Analytics by us, the data collected in this context will be deleted.

Insofar as information is transferred to Google servers in the USA and stored there, the American company Google LLC is certified under the EU-US Privacy Shield. A current certificate can be viewed here. Based on this agreement between the USA and the European Commission, the latter has determined an adequate level of data protection for companies certified under the Privacy Shield.

This will prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google.

Cookiebot Consent Management Platform:
On our website, we use Cookiebot to inform you about the technologies we use on our website and to obtain, manage and document your consent to the processing of your personal data by these technologies. This is necessary pursuant to Art. 6 (1) p. 1 lit. c DSGVO to comply with our legal obligation under Art. 7 (1) DSGVO to be able to prove your consent to the processing of your personal data, to which we are subject. The consent management service Cookiebot is offered by Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark, which processes your data on our behalf.

After you submit your cookie declaration on our website, Cookiebot’s web server stores your anonymised IP address, the date and time of your declaration, browser information, the URL from which the declaration was sent, information about your consent behaviour and an anonymous random key. In addition, a “CookieConsent” cookie is used, which contains the information about your consent behaviour and the key. Your data will be deleted after twelve months, unless you have expressly consented to further use of your data in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

Google Ads
We use Google Ads to advertise this website in Google search results and on third-party websites. For this purpose, the so-called remarketing cookie is set by Google when you visit our website, which automatically enables interest-based advertising by means of a pseudonymous cookieID and on the basis of the pages you have visited. This serves to protect our legitimate interests in the optimal marketing of our website, which outweigh our interests in the context of a balancing of interests in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO. After the end of the purpose and the end of the use of Google Ads Remarketing by us, the data collected in this context will be deleted.

Further data processing will only take place if you have consented to Google linking your web and app browsing history to your Google Account and using information from your Google Account to personalise the ads you see on the web. In this case, if they are logged into Google while visiting our website, Google will use your data together with Google Analytics data to create and define target group lists for cross-device remarketing. For this purpose, your personal data will be temporarily linked by Google with Google Analytics data in order to form target groups.

Our website participates in the Amazon affiliate programme. This is offered by Amazon Europe Core S.à r.l. (Société à responsabilité limitée), 5 Rue Plaetis, L-2338 Luxembourg (hereinafter “Amazon”). Amplitude is a service that enables data analysis of app users. The service is published by Amplitude Inc, 501 2nd Street, Suite 100 San Francisco, CA 94107, USA. 

Softbrik
Softbrik is a technical provider that makes it possible to collect voice feedback. We use this provider to enable customers within our app to share their impressions of the app and make suggestions for improvements. 

Bugsnag
Bugsnag is a technical provider that analyses technical problems such as app crashes and contributes to product improvement.

Facebook
The Facebook tool is provided by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. You can find more information about this tool here.

Klaviyo
Klaviyo is a provider of CRM software. The provider is registered in the USA: “Klaviyo”, 225 Franklin St, Boston, MA 02110, USA.

The e-mail addresses of our newsletter recipients are stored by Klaviyo on servers in the USA. Klaviyo is certified under the “Privacy Shield”. For more information on Klaviyo’s privacy policy, please follow this link.

Integration of the Trusted Shops Trustbadge
The Trusted Shops Trustbadge is integrated on this website in order to display our Trusted Shops seal of approval and any ratings collected, as well as to offer Trusted Shops products to buyers after they have placed an order.

This serves to protect our legitimate interests in optimal marketing by enabling secure shopping in accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, which prevail in the context of a balancing of interests. The trust badge and the services advertised with it are an offer of Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. The Trustbadge is provided by a CDN provider (Content Delivery Network) within the framework of order processing. Trusted Shops GmbH also uses service providers from the USA. An appropriate level of data protection is ensured. Further information on the data protection of Trusted Shops GmbH can be found here.

When the Trustbadge is called up, the web server automatically saves a so-called server log file, which also contains your IP address, the date and time of the call-up, the amount of data transferred and the requesting provider (access data) and documents the call-up. Individual access data are stored in a security database for the analysis of security anomalies. The log files are automatically deleted 90 days after creation at the latest.

Further personal data is transferred to Trusted Shops GmbH if you decide to use Trusted Shops products after completing an order or if you have already registered to use them. The contractual agreement between you and Trusted Shops applies. For this purpose, personal data is automatically collected from the order data. Whether you as a buyer are already registered for product use is automatically checked using a neutral parameter, the email address hashed by cryptological one-way function. The e-mail address is converted into this hash value, which cannot be decrypted by Trusted Shops, before it is transmitted. After checking for a match, the parameter is automatically deleted.

This is necessary for the fulfilment of our and Trusted Shops’ overriding legitimate interests in the provision of the buyer protection linked to the specific order in each case and the transactional evaluation services in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO. 2.6 Customer support
If you contact our customer support, Plantura employees may access your stored data in order, for example, to order returns or to make a statement about the orders you have placed or to make statements about the payment status of your order.

The basis for processing this data is Art. 6 (1) b of the DSGVO.

2.7 Advertising to existing customers
If you have ordered goods or services from us, we will send you information emails for similar goods or services by email in the future. The legal basis for this use is our legitimate interest in conducting direct marketing and providing you with meaningful offers of goods and services that meet your expectations and needs and fulfil our commercial interests (Art. 6 (1) F of the DSGVO, §7 (3) UWG). You can request at any time to no longer receive such information emails from us for similar goods or services. To do so, please contact us by e-mail at contact@plantura.garden or at the contact details provided in the imprint or click on the link at the end of the information e-mails.

2.8 Data processing based on your consent
In addition to the purposes of data processing listed in points 2.1 – 2.7, the basis for data processing is primarily your consent in accordance with Art. 6 (1) a of the DSGVO. This consent can be given, for example, when ordering our newsletter, when agreeing to our privacy policy in the ordering and purchasing process or during telephone conversations with our customer support.

3. Website offers & cookies

Plantura offers you offers both in our magazine (www.plantura.garden) and in our online shop (shop.plantura.garden). Both offers are merged at Plantura from a technical point of view and we use the data from both offers. Depending on how you use the offers, different data is generated and processed. When you use our offerings, we also use common tracking technologies using tracking pixels and identification cookies. We may use this data for the points listed in paragraph 2 and in particular for the personalised offers and existing customer advertising.

3.1 Cookies
We use cookies to make your visit to the website more attractive and to ensure the use of certain functions.

Cookies are text files that are stored on your devices. A distinction is made between session cookies, which are deleted at the end of the session, and persistent cookies, which are stored in order to recognise you on your next visit. In your cookie settings of your web browser you will find more detailed information about the stored cookies. If you do not accept the cookies on our site, your use may be restricted.

The cookies used on our site may come from Plantura directly or from third parties. You can set most browsers to block third party cookies. Four categories of cookies are used on our Offerings:

  • Necessary cookies: these cookies make the website services usable by enabling basic functions such as site navigation and access to content. Without these cookies, the services will not function properly.
  • Preference cookies: These cookies influence the way a website behaves, e.g. the preferred language or region is saved.
  • Statistics cookies: These cookies help to better understand website visitors and analyse how visitors interact with the website.
  • Marketing cookies: These cookies contain identifiers to follow your visit to the website. Furthermore, these cookies are used to enable personalised offers.

3.2 Online marketing & retargeting
Plantura uses cookies and similar tracking technologies from advertising partners (such as Criteo, Google and Facebook) who operate an advertising network. The advertising partners are enabled to present personalised advertising on other websites and apps based on the websites you visit on Plantura (so-called retargeting). You can also find a list of providers under 2.5 Data analysis.

4. Social media plugins

Buttons from social media networks are integrated into the various offers at Plantura. This integration takes place within the framework of a balancing of interests and the overriding legitimate interest in marketing our offer optimally in accordance with Art. 6 (1) F of the DSGVO.

Our presence on social networks and platforms serves to improve active communication with our customers and interested parties. We provide information there about our products and ongoing special promotions.

When visiting our online presences in social media, your data may be automatically collected and stored for market research and advertising purposes. So-called usage profiles are created from this data using pseudonyms. These can be used, for example, to place advertisements within and outside the platforms that presumably correspond to your interests. Cookies are generally used on your terminal device for this purpose. Visitor behaviour and user interests are stored in these cookies. This serves in accordance with Art. 6 Para. 1 lit. f. DSGVO, this serves to protect our legitimate interests in an optimised presentation of our offer and effective communication with customers and interested parties, which prevail in the context of a balancing of interests. 5. Newsletter

5.1 Newsletter types
You can subscribe to various newsletter services offered by Plantura, which offer different things:

  • Plantura Garden Mail: Information about current topics, trends and new products from Plantura. This usually comes once a week on Sunday
  • Reminder services: You can sign up for newsletters that automatically send you a reminder when a product is available again; a reminder about the right time to fertilise; a reminder for early detection of, for example, pests such as the boxwood borer
  • Basic courses: You can register in various ways (such as via a QR code on product packaging) for basic courses that provide specific knowledge about the product. For example, there is the Garden Year Basic Course, which is a companion through the garden year as part of our Plantable Calendar.
  • Recommendation mails: Based on your order, we can send you recommendations for suitable, similar products and services. 

5.2 Newsletter registration
In the case of Plantura basic courses and recommendation mails, we refer to existing customer advertising as outlined in 2.7. The legal basis for this use is our legitimate interest in conducting direct marketing and providing meaningful offers of goods and services that meet your expectations and needs and fulfil our commercial interests (Art. 6 (1) F of the DSGVO, §7 (3) UWG).

If you register for our newsletter requiring consent, such as our garden post or our reminder services, we use the so-called double opt-in procedure. In this process, you will receive an email after registering for the newsletter to confirm your email address. Only after this confirmation do we include your email address in the newsletter distribution list.

5.3 Unsubscribing from the newsletter
You can unsubscribe from our newsletters at any time by using the unsubscribe link which can be found in every newsletter.

6. Vouchers

When you purchase a voucher from Plantura, we use the information provided to verify and process that voucher to prevent potential fraud. To do this we may record, amongst other things, the voucher value, the voucher code and the time the voucher was redeemed and the name of the person redeeming the voucher.

7. Data transfer

Plantura will share your data with partners for selected purposes, such as our logistics partner. These partners will only have access to your data to the extent necessary to provide the relevant services.

7.1 Shipping company
